Chapter 2 introduces the main variables which influence the analysis undertaken, beginning with the relationship between consumer and competition law. A consideration of the role of competition law vis-à-vis consumer law facilitates the subsequent discussion on ‘consumer interest’ in EU competition law. In relation to ‘consumer interest’ it points to the inconsistencies between its frequent presence in the Commission’s policy documents and its rather limited role in European courts’ case law and the Commission’s substantive enforcement practice. This finding points to the need for more active consumer involvement in actual competition law enforcement as an alternative route for bringing consumer interests to the fore.
