Whether a person who was not active as a supplier or customer on the market affected by a cartel could seek damages for losses allegedly caused by an infringement of Article 101 of the Treaty on the Functioning of the European Union when it grants subsidies, in the form of promotional loans to a direct purchaser of cartelized goods, where the overcharge could have been used more profitably.
