Whether a national competition authority (‘NCA’) could request the presence of a company’s executive director during a dawn raid when the dawn raid was initiated at a time the manager was not present at the company’s premises.

Whether an NCA could require the blocking and extraction of the contents of an executive director’s mailbox and the delivery of these contents to the premises where a dawn raid occurred, despite the absence of the executive director at the premises.

Whether evidence acquired during a dawn raid could be used in administrative proceedings concerning a possible competition law infringement.
