This chapter considers the rules on State aid as they apply to the energy sector and environmental protection measures. The chapter sets out the specific issues that arise in considering the existence of aid under Article 107(1) in relation to energy and environmental support measures. It goes on to consider the application of the General Block Exemption Regulation (GBER) to energy and environmental aid. The chapter then discusses the application of the Environmental and Energy Aid Guidelines to aid not covered by the GBER, as well as the Emission Trading Scheme (ETS) Guidelines. The rules on State aid for stranded costs are outlined, before turning to a more detailed discussion of State aid in the nuclear energy sector. The chapter concludes with a discussion of the rules on State aid for the coal sector.
